IS BEST BUY SELLING USED GOODS AS NEW?

Best Buy has been sued or investigated by the Attorneys General of New Jersey, Ohio and Wisconsin for, among other things, deceptively advertising and selling repackaged used goods as new to consumers. New Jersey’s Attorney General entered an agreement with Best Buy under which Best Buy paid $133,500 and agreed, among other things, to stop deceptively advertising and selling used goods as new to New Jersey consumers. www.accessmylibrary.com/coms2/summary_0286-8530004_ITM

Since Best Buy’s agreement with the New Jersey Attorney General, consumers have continued to report numerous instances in New Jersey and elsewhere of Best Buy selling them goods as "new" when, in fact, those goods were used, repackaged, repaired or reconditioned, returned by another customer after being used by them or otherwise were not "new." Goods reported as being sold by Best Buy as “new” when they were not include:

  • consumer electronics (video and audio products)
  • home office products (desktop and notebook computers, monitors, mobile phones, hard drives, etc.)
  • entertainment software (computer and video gaming hardware and software, DVDs and CDs)
  • appliances (washers, dryers, refrigerators, microwave or conventional ovens, toasters, etc.)
